They're appealing the denial of motion to dismiss huh? I agree that this case really doesn't have legs but I didn't know that was an interlocutory appeal that they could do. They'd win in summary judgement regardless.

eh... anyone can be "radicalized" by anything. is anyone suing Mecca when islamic fundamentalists jihad someone/something? is anyone suing the Catholic church because of christian fundamentalists doing the same thing?

holding tech companies liable because some crazy dumbshit did a bad thing is disingenuous at best. Judge's ruling isnt going to stand.

Personally I believe in free will. Nothing should take any responsibility away from the one that chose to kill.
